8th CPC Supreme Court case explained: क्या challenge हुआ है, court ने क्या order दिया और defence personnel के लिए इसका क्या मतलब नहीं है?

8th CPC Supreme Court case explained: क्या challenge हुआ है, court ने क्या order दिया और defence personnel के लिए इसका क्या मतलब नहीं है?

8th Central Pay Commission को लेकर Supreme Court में एक important constitutional challenge सामने आया है, लेकिन इसे “8th CPC के खिलाफ case” या “Pay Commission पर stay” कहना सही नहीं होगा।

Case है:

Maharashtra State Judges Association v. Union of India & Others, W.P.(C) No. 650/2026

2 September 2026 को Supreme Court ने केवल notice issue किया और matter को 14 October 2026 के लिए returnable रखा। Court ने अभी merits पर कोई final finding नहीं दी है और 8th CPC के functioning पर कोई stay नहीं लगाया है।

असल challenge किस clause को लेकर है?

8th CPC की official Terms of Reference में कई employee categories expressly शामिल हैं। इनमें Defence Forces personnel भी शामिल हैं और Clause 2(a)(ix) में Union Territories के subordinate courts के judicial officers को भी Commission के scope में रखा गया है।

Official Gazette में judicial officers के लिए एक special note भी दिया गया है। Commission को Supreme Court के 24 August 1993 के principle का पालन करना है कि judges की service conditions को administrative executive से link नहीं किया जाना चाहिए और judiciary की special needs को ध्यान में रखना चाहिए।

Petition का objection यही है कि इस safeguard के बावजूद subordinate judiciary को Central Pay Commission mechanism में रखना judicial independence के पुराने Supreme Court principles के अनुरूप नहीं है।

Petitioners Supreme Court से क्या चाहते हैं?

Maharashtra State Judges Association ने broadly दो major reliefs मांगी हैं।

पहला, Union Territories के subordinate judicial officers को 8th CPC की Terms of Reference से बाहर किया जाए।

दूसरा, judiciary के लिए एक National Judicial Pay Commission (NJPC) बनाया जाए जो judges की pay, allowances, pension, service conditions और related facilities को separately examine करे। Petition Supreme Court, High Courts और District/Subordinate Judiciary के लिए broader judicial compensation framework की मांग करती है।

क्या Petition 8th CPC को पूरी तरह cancel करना चाहती है?

No.

यह बहुत important distinction है।

Petition 8th CPC के पूरे mandate को unconstitutional declare कराने की मांग नहीं करती। Challenge specifically judicial officers के inclusion और judicial pay-setting mechanism से जुड़ा है।

इसलिए:

8th CPC = continuing

Judicial-pay clause = under challenge

यह दोनों अलग बातें हैं।

18 months और 3 months वाली demand क्या है?

Petition ने proposed National Judicial Pay Commission के लिए specific timeline भी मांगी है।

Reported prayers के अनुसार:

ये Supreme Court के आदेश नहीं हैं। ये petitioner’s prayers हैं।

DA का connection क्यों आया है?

Petition चाहती है कि दो Judicial Pay Commissions के बीच judicial pay को Central Government employees के Dearness Allowance revisions के साथ adjust करने का mechanism हो।

लेकिन इससे Central employees के DA/DR पर कोई Supreme Court decision नहीं हुआ है।

यह case:

DA merger, DR merger या Central employees की DA calculation पर litigation नहीं है।

क्या interim salary revision भी मांगी गई है?

Yes.

Association ने interim measure के रूप में Supreme Court और High Court judges की salary 1 January 2026 से revise करने की मांग भी रखी है।

लेकिन इसे Court order नहीं समझना चाहिए।

अभी यह सिर्फ interim prayer है।

Fitment factor पर Supreme Court कुछ decide कर रहा है?

No.

इस case में:

2.86, 3.0, 3.68, 3.83

या किसी अन्य 8th CPC fitment factor पर Supreme Court consideration का कोई basis नहीं है।

यह case minimum pay, Pay Matrix या general Central Government salary formula decide नहीं कर रहा।

इसलिए headline:

“Supreme Court में 8th CPC Fitment Factor Challenge”

misleading होगी।

8th CPC Terms of Reference में Defence Forces की position क्या है?

Official Gazette में Clause 2(a)(iii) clearly “Personnel belonging to the Defence Forces” को 8th CPC के scope में रखती है।

इस judicial petition ने Defence Forces के inclusion को challenge नहीं किया है।

Defence pay history फिर relevant क्यों है?

यह case defence personnel पर directly लागू नहीं होता, लेकिन institutional comparison के लिए defence pay history useful है।

7th CPC report records करती है कि Armed Forces pay determination historically अलग committees और later Central Pay Commissions के through evolve हुआ। इसमें Post War Pay Committee, Raghuramaiah Committee और बाद के Pay Commissions का detailed record दिया गया है।

7th CPC ने यह भी record किया कि Defence Forces की service conditions civilians से materially different हैं और अलग historical/traditional relativities को consider करना पड़ता है।

लेकिन यहां एक crucial legal distinction है:

Judiciary की constitutional independence और Armed Forces की specialised service conditions अलग legal foundations पर based हैं।

इसलिए judges के लिए separate pay mechanism का argument automatically Armed Forces के लिए separate Pay Commission का constitutional right नहीं बना देता।

तो Defence community के लिए इस case की relevance क्या है?

Direct legal benefit अभी नहीं है।

लेकिन policy discussion के स्तर पर यह case एक broader question उठाता है:

क्या highly specialised services के pay और service conditions को general Pay Commission framework में specialised treatment की जरूरत है?

Defence Forces के लिए 8th CPC ToR already specialised needs को consider करने का mandate देता है, और official Gazette में Defence personnel expressly covered हैं।

इसलिए defence angle अभी policy comparison है, legal consequence नहीं।

Supreme Court ने 2 September को exactly क्या किया?

Actual Record of Proceedings बहुत छोटा है।

Bench consisted of:

Chief Justice of India Surya Kant

Justice Joymalya Bagchi

Justice V. Mohana

और Court का operative order सिर्फ इतना था:

“Issue notice, returnable on 14.10.2026.”

यानी अभी:

Notice → responses → further hearing

का stage है।

Merits पर कोई final adjudication नहीं हुई।

क्या confirmed है और क्या assume नहीं करना चाहिए?

8th CPC Supreme Court case को general salary litigation की तरह देखना गलत होगा।

Real issue है:

क्या Union Territories के subordinate judicial officers की pay और service conditions Central Pay Commission examine करे, या judiciary के लिए independent National Judicial Pay Commission होना चाहिए?

Supreme Court ने अभी केवल notice issue किया है। 14 October 2026 अगली important date है।

Central Government employees, pensioners और Defence personnel के लिए फिलहाल सबसे important clarification यही है:

8th CPC पर stay नहीं है।

Fitment factor challenge नहीं हुआ है।

DA/DR पर फैसला नहीं हुआ है।

Separate Defence Pay Commission order नहीं हुआ है।

Defence personnel अभी भी official 8th CPC Terms of Reference के अंदर हैं।
