Calcutta High Court के 25 August 2026 के एक judgment ने यह दिखाया कि एक ही FIR में नाम आने के बावजूद दो accused का legal outcome पूरी तरह अलग हो सकता है—यदि उनके खिलाफ उपलब्ध evidence अलग हो।
Arun Prasad, जो Territorial Army में serving soldier थे, के official military records ने दिखाया कि alleged incident के समय वह Imphal, Manipur में active duty पर थे। Police investigation ने भी इस record को verify कर उनके संबंध में Final Report file की। दूसरी ओर उनके brother Arjun Prasad के खिलाफ eyewitness statements, injury reports और local presence से जुड़ा prima facie material case diary में मौजूद था।
Result:
Arun Prasad — proceedings quashed
Arjun Prasad — trial to continue
इस judgment की सबसे useful legal learning Army personnel को कोई special immunity मिलना नहीं है। असली मुद्दा यह है कि authenticated institutional records और disputed factual evidence को Court किस तरह अलग-अलग treat करता है।
Case में dispute कहां से शुरू हुआ था?
Matter Hooghly के Makhla area में एक 4-foot common passage और drainage easement से जुड़े neighbourhood/property dispute से निकला था। Parties के बीच civil litigation पहले से चल रही थी और Title Suit No. 470 of 2023 भी pending था।
इसके बाद complainant ने Section 156(3) CrPC के तहत private complaint approach किया, जिससे Uttarpara Police Station Case No. 445 of 2023, dated 6 December 2023, register हुआ।
Complaint में allegation था कि 5 October 2023, around 6:30 AM, complainant को Satadol Club के पास रोका गया, assaulted किया गया, property खाली कराने का pressure डाला गया, ₹7,500 allegedly taken किए गए और threats दिए गए। FIR में Arun Prasad और Arjun Prasad दोनों को implicate किया गया था।
इन allegations की truthfulness पर High Court ने final finding नहीं दी; जहां disputed evidence बचा, उसे trial के लिए छोड़ा गया।
Arun Prasad के खिलाफ allegation का सबसे बड़ा evidentiary problem क्या था?
Complaint Arun को alleged occurrence के समय Hooghly में physically present मानती थी।
लेकिन investigation के दौरान उनके Commanding Officer, B-Company, 25 BRTE, Imphal, Manipur की official certification सामने आई। उस record के अनुसार Arun उसी relevant date और time पर Imphal में active military duty पर मौजूद थे।
यह सामान्य oral alibi नहीं था।
यह था:
Exact alleged time
vs
Official duty-location record
Police ने इस verification को accept किया और Arun के खिलाफ Final Report submit कर उन्हें allegations से drop कर दिया।
Court ने military record को ordinary alibi से अलग क्यों माना?
Criminal cases में accused का यह कहना कि “मैं घटना के समय वहां नहीं था” सामान्यतः trial में evidence से prove किया जाता है।
High Court ने इस case में distinction बनाया।
Court ने कहा कि Arun का defence:
- family member की statement नहीं था;
- private witness पर dependent नहीं था;
- बाद में बनाया गया self-serving claim नहीं था.
यह operational Army unit के Commanding Officer से officially verified record था और prosecution agency ने स्वयं उसे accept किया था।
Judgment के अनुसार जब investigating agency ही accused की alleged crime scene पर presence को physically impossible मानकर उसे drop कर चुकी हो, तो ऐसे व्यक्ति के खिलाफ criminal proceeding का shadow बनाए रखना abuse of process बन सकता है।
यही इस judgment का strongest evidence-law aspect है।
फिर Court intervention की जरूरत क्यों पड़ी जब police Arun को पहले ही drop कर चुकी थी?
यह procedural point थोड़ा technical है।
Police investigation के बाद:
Arun Prasad के संबंध में Final Report दी गई,
जबकि:
Arjun Prasad के खिलाफ Chargesheet No. 20 of 2024 dated 31 January 2024 file हुई।
High Court ने अपने final order में formally declare किया कि Uttarpara P.S. Case No. 445 of 2023, Chargesheet No. 20 of 2024 और G.R. Case No. 3095 of 2023 से arising proceedings Arun Prasad के संबंध में quashed and set aside रहेंगी, noting that investigation had already dropped him through the Final Report.
इसलिए “Final Report” और “quashing” को एक ही procedural action नहीं समझना चाहिए।
पहला investigation stage पर police का position था; दूसरा High Court का formal judicial order।
Arjun Prasad को वही relief क्यों नहीं मिली?
यहीं judgment सबसे instructive हो जाता है।
Arjun के मामले में कोई comparable official record नहीं था जो alleged scene पर उनकी presence को objectively impossible बनाता।
इसके बजाय case diary में Court ने:
- Section 161 CrPC witness statements;
- injury reports;
- local presence;
- alleged restraint और assault से जुड़ा prima facie material
देखा।
High Court ने कहा कि witnesses सच बोल रहे हैं या नहीं, altercation वास्तव में कैसे हुआ और defence version सही है या नहीं—ये सब disputed questions of fact हैं।
इन questions को Section 482 proceedings में decide करना mini-trial जैसा हो जाता। इसलिए Arjun के खिलाफ case quash नहीं किया गया और trial continue करने का direction दिया गया।
Same FIR में दोनों brothers का evidence कितना अलग था?

यह comparison judgment का central legal logic समझने का सबसे आसान तरीका है।
क्या civil property dispute होने से criminal case खत्म हो जाना चाहिए था?
नहीं।
Petitioners ने argue किया था कि criminal proceeding ongoing civil property dispute का retaliatory counterblast थी।
लेकिन High Court ने distinction maintain किया।
Court ने Mohammed Ibrahim v. State of Bihar के principle का reference लेते हुए कहा कि civil dispute का existence अपने आप criminal prosecution को invalidate नहीं करता, यदि investigative material independent criminal offence के ingredients prima facie disclose करता हो।
इस case में यही reasoning Arjun पर apply हुई।
इसलिए:
Civil dispute exists

Every criminal allegation automatically false
लेकिन यदि particular accused के खिलाफ allegation objectively impossible official evidence से contradicted हो, उसका position अलग evaluate किया जा सकता है।
Section 482 CrPC यहां कैसे relevant हुआ?
Petition Section 482 read with Section 401 CrPC के तहत थी।
Section 482 High Court की inherent powers से संबंधित है। इसका इस्तेमाल exceptional situations में abuse of process रोकने या ends of justice secure करने के लिए किया जा सकता है।
Court ने State of Haryana v. Bhajan Lal principles पर विचार किया।
लेकिन judgment दो boundaries एक साथ दिखाता है:
जहां allegation official, unimpeachable material से collapse हो जाए
→ threshold intervention possible हो सकता है.
जहां eyewitnesses, injury material और factual disputes मौजूद हों
→ trial को ordinarily अपना काम करने देना चाहिए.
इसलिए Section 482 को general “case dismiss कराने” का shortcut समझना सही नहीं होगा।

क्या इस judgment से Army personnel के लिए कोई special legal protection बन गई है?
नहीं।
Judgment किसी serving soldier को उसके status के कारण criminal proceedings से blanket immunity नहीं देता।
Arun को relief इसलिए मिली क्योंकि:
- allegation specific समय और location से जुड़ा था;
- military authority का record exact relevant period cover करता था;
- police ने उस record को independently verify किया;
- official record ने alleged physical presence को impossible बनाया.
Future case में सिर्फ unit letter या service certificate दिखाना automatically enough होगा—ऐसा judgment नहीं कहता।
अगर official record itself disputed हो, relevant time cover न करे या contrary evidence मौजूद हो, Court का approach अलग हो सकता है।
Serving personnel के लिए इस judgment से कौन-सा practical lesson निकलता है?
यह case service records की potential evidentiary value दिखाता है, खासकर तब जब allegation किसी specific date, time और place पर physical presence पर depend करता हो।
Relevant circumstances में useful institutional records हो सकते हैं:
- authorised duty-location record;
- movement/temporary duty order;
- leave record;
- official attendance;
- authorised travel record;
- unit correspondence;
- competent authority certification.
लेकिन ये examples कोई Court-prescribed compulsory checklist नहीं हैं।
इस judgment में decisive material था Commanding Officer की verified duty certification, जिसे investigating agency ने भी accept किया था।
Practical lesson record manufacture करना नहीं, बल्कि contemporaneous official records preserve और properly obtain करना है।
क्या confirmed है और क्या इस judgment से assume नहीं करना चाहिए?
Confirmed
- Case CRR 2356 of 2024 था.
- Judgment 25 August 2026 को Justice Uday Kumar ने pronounce किया.
- Arun Prasad serving Territorial Army soldier थे.
- Commanding Officer record ने relevant time पर उनकी Imphal duty establish की.
- Police ने उनके संबंध में Final Report submit की.
- High Court ने Arun के खिलाफ proceedings formally quash कीं.
- Arjun Prasad के खिलाफ quashing reject हुई.
- Trial Court को Arjun का trial expeditiously proceed करने को कहा गया.
Assume नहीं करना चाहिए
- दोनों brothers acquitted हो गए.
- पूरा FIR false judicially declare कर दिया गया.
- civil dispute होने से criminal case invalid हो गया.
- Army certificate हर criminal case में conclusive होगा.
- serving soldiers को special criminal immunity मिल गई.
- Arjun के खिलाफ allegations prove हो चुके हैं.
Arjun के मामले में Court ने केवल इतना माना कि trial के लिए sufficient prima facie material है; guilt या innocence trial में decide होगी।
इस judgment का सबसे महत्वपूर्ण legal takeaway क्या है?
यह case Army status के बारे में कम और quality of evidence के बारे में ज्यादा है।
एक ही FIR में दो family members accused थे। दोनों ने same proceeding quash कराने की मांग की। फिर भी Court ने एक को relief दी और दूसरे को नहीं।
Difference था:
Arun के खिलाफ allegation → authenticated official evidence से objectively contradicted
जबकि:
Arjun के खिलाफ allegation → disputed factual evidence से supported prima facie case
इसीलिए judgment का practical principle simple है:
Criminal case में surname, relationship या common FIR outcome तय नहीं करते; प्रत्येक accused के खिलाफ available evidence की legal quality अलग-अलग examine होती है।
अब Arjun के खिलाफ trial को High Court के merits-related observations से uninfluenced होकर आगे बढ़ना है। यही इस case का अगला legal stage है।
