₹21,000 eligibility vs ₹7,000 calculation base: New bonus Gazette में दोनों numbers का असली मतलब क्या है?

₹21,000 eligibility vs ₹7,000 calculation base: New bonus Gazette में दोनों numbers का असली मतलब क्या है?

25 August 2026 को Ministry of Labour & Employment ने Code on Wages, 2019 के Section 26 से जुड़े दो Gazette notifications जारी किए। इन notifications को पढ़े बिना केवल ₹21,000 और ₹7,000 देखकर यह मान लेना आसान है कि Government ने ₹21,000 का bonus घोषित कर दिया है या bonus calculation ceiling बढ़ाकर कोई नया financial benefit दे दिया है।

असल में दोनों numbers का काम अलग है।

₹21,000 यह तय करता है कि statutory bonus framework में employee eligibility ceiling क्या होगी।

जबकि

₹7,000 या Central Government द्वारा fixed applicable minimum wage—जो भी अधिक हो—eligible employee के लिए bonus calculation base तय करता है, यदि उसकी monthly wage ₹7,000 से अधिक है।

दोनों notifications 21 November 2025 से effective मानी गई हैं, क्योंकि Code on Wages के relevant provisions उसी तारीख से लागू हुए थे।

S.O. 4711(E) कहता है कि ₹21,000 per month से अधिक wages न पाने वाले employees के लिए Section 26(1) का statutory bonus framework लागू होगा, subject to the other requirements of the Code.

S.O. 4710(E) कहता है कि eligible employee की wage ₹7,000 per month से ज्यादा है तो bonus उसकी पूरी actual wage पर calculate करने के बजाय ₹7,000 या Central Government द्वारा fixed minimum wage—जो भी ज्यादा हो—उस base पर calculate होगा.

यही दोनों Gazette को साथ पढ़ना जरूरी बनाता है।

सबसे important difference: Eligibility और Calculation एक चीज नहीं हैं

मान लीजिए किसी employee की monthly wage ₹18,000 है।

सबसे पहले पूछा जाएगा:

क्या ₹18,000 eligibility ceiling ₹21,000 के भीतर है?

Yes.

लेकिन अगला सवाल अलग होगा:

Bonus calculation किस wage figure पर होगी?

यदि relevant Central minimum wage ₹12,000 है:

₹7,000 vs ₹12,000

Higher amount = ₹12,000

इसलिए calculation base ₹18,000 नहीं, बल्कि ₹12,000 होगा.

अगर relevant minimum wage ₹6,500 होती, तो:

₹7,000 vs ₹6,500

Higher amount = ₹7,000

इसलिए calculation base ₹7,000 होता.

इसी वजह से ₹21,000 को calculation ceiling समझना गलत है।

क्या ₹21,000 का मतलब ₹21,000 bonus मिलेगा?

No.

₹21,000 = wage eligibility ceiling

यह नहीं है:

  • ₹21,000 guaranteed bonus;
  • ₹21,000 calculation base;
  • ₹21,000 Diwali bonus;
  • ₹21,000 minimum wage;
  • सभी employees के लिए ₹21,000 payment.

Similarly, ₹7,000 भी bonus amount नहीं है।

यह एक calculation benchmark है।

इस distinction के बिना दोनों notifications का meaning पूरी तरह बदल जाता है।

Section 26 में minimum bonus कितना है?

Code on Wages का Section 26 केवल eligibility ceiling की बात नहीं करता।

Section 26(1) के अनुसार covered employee ने accounting year में कम से कम 30 days work किया हो तो annual minimum bonus सामान्य रूप से:

8⅓% of wages earned OR ₹100, whichever is higher

के आधार पर payable है, subject to the other provisions of the Code.

और जहां allocable surplus अधिक हो, Section 26(3) bonus को proportionately बढ़ने देता है, लेकिन statutory maximum 20% of wages तक सीमित करता है।

इसलिए:

₹7,000 / minimum wage = calculation base

जबकि

8⅓% to maximum 20% = statutory bonus rate framework

दोनों को mix नहीं करना चाहिए।

क्या actual salary पर bonus calculate होगा?

हर case में नहीं।

यदि eligible employee की wage ₹7,000 से अधिक है, तो S.O. 4710(E) actual salary को calculation base बनाने के बजाय prescribed formula लागू करता है:

₹7,000 or Central Government minimum wage, whichever is higher.

21 November 2025 से retrospective effect क्यों दिया गया?

दोनों August 2026 notifications कहती हैं कि वे 21 November 2025 से लागू मानी जाएंगी.

यह date random नहीं है।

Ministry of Labour & Employment की S.O. 5322(E), dated 21 November 2025 ने Code on Wages, 2019 के Sections 1–41 सहित major provisions को उसी तारीख से brought into force किया था.

Ministry की year-end review ने भी confirm किया कि four Labour Codes 21 November 2025 से effective किए गए थे.

इसलिए August 2026 notifications essentially नए Code के operational commencement के साथ ceilings को align करती हैं।

क्या ₹7,000 और ₹21,000 दोनों figures पहली बार आए हैं?

यह सबसे interesting legal point है।

No, numbers themselves are not new.

Earlier Payment of Bonus Act, 1965 में भी Section 12 के तहत employees whose wages exceeded the prescribed level के लिए calculation formula:

₹7,000 or applicable minimum wage, whichever is higher

था.

पुराने statutory framework में ₹21,000 eligibility ceiling भी पहले से मौजूद थी.

इसलिए August 2026 development को यह कहना कि:

“Government ने पहली बार bonus calculation ₹7,000 कर दिया”

technically misleading होगा।

Better interpretation यह है:

Old statutory thresholds have now been formally determined under the Code on Wages framework.

यानि legal framework बदला है; दोनों headline figures fundamentally नए नहीं हैं।

तो actual change क्या है?

Actual significance तीन हिस्सों में है:

First: statutory bonus अब Code on Wages, 2019 के framework में operate कर रहा है.

Second: Central Government ने Section 26 के लिए required wage thresholds formally notify कर दिए हैं.

Third: दोनों notifications को 21 November 2025 से deemed effective किया गया है.

इसलिए इसे सिर्फ “bonus बढ़ गया” वाली खबर की तरह देखना गलत होगा।

यह ज्यादा सही तौर पर एक statutory bonus framework operationalisation and clarification है।

क्या इसका मतलब Central Government employees को नया bonus मिल गया?

यह distinction विशेष रूप से Central Government employees और defence-related audience के लिए जरूरी है।

ये notifications Code on Wages के statutory bonus provisions से संबंधित हैं।

इनमें यह नहीं कहा गया कि:

  • सभी Central Government employees को नया bonus sanction हो गया;
  • Non-Productivity Linked Bonus की नई राशि approve हो गई;
  • Productivity Linked Bonus की नई rate तय हो गई;
  • Diwali/Dussehra bonus order जारी हो गया;
  • ₹21,000 Central Government employee bonus sanction है.

Central Government departments के PLB/Non-PLB payments के लिए relevant departmental/Department of Expenditure sanction orders को अलग से देखना होगा।

इस Gazette को अकेले किसी Government employee के लिए festival bonus sanction order मानना उचित नहीं है।

₹21,000 से ज्यादा wage होने पर क्या होगा?

S.O. 4711(E) specifically Section 26(1) के लिए employees drawing wages not exceeding ₹21,000 per month की ceiling determine करता है.

इसलिए ₹21,000 से ऊपर wage होने वाले employee को केवल इस statutory notification के आधार पर Section 26(1) eligibility assume नहीं करनी चाहिए।

लेकिन employer-specific agreements, settlements, contractual bonus arrangements या other applicable schemes अलग हो सकती हैं। यह Gazette उन सभी independent arrangements को automatically define नहीं करता।

₹7,000 से कम wage हो तो calculation कैसे समझें?

S.O. 4710(E) की special calculation provision specifically उस eligible employee के लिए है जिसकी wage ₹7,000 से अधिक है.

इसका मतलब यह notification ₹7,000 से नीचे wages वाले employee के लिए artificial ₹7,000 base create नहीं करती।

वह employee Section 26 और applicable wage provisions के अनुसार अलग तरीके से assessed होगा।

यह nuance भी महत्वपूर्ण है क्योंकि “हर employee का bonus ₹7,000 base पर calculate होगा” कहना गलत होगा।

  • S.O. 4711(E) fixes ₹21,000/month Section 26(1) eligibility ceiling.
  • S.O. 4710(E) fixes the above-₹7,000 calculation mechanism.
  • Both notifications are dated 25 August 2026.
  • Both are deemed effective from 21 November 2025.
  • Code on Wages relevant provisions came into effect on 21 November 2025.
  • Section 26 provides an annual minimum bonus framework and a maximum 20% ceiling subject to its conditions.
  • The earlier Payment of Bonus Act already contained the ₹7,000-or-minimum-wage calculation formula.

Do not assume

  • Government has announced a flat ₹21,000 bonus.
  • Every Central Government employee will receive ₹21,000.
  • ₹21,000 is the calculation base.
  • ₹7,000 is the amount paid as bonus.
  • August 2026 created both numerical limits for the first time.
  • This Gazette itself sanctions PLB or Non-PLB for Government employees.
  • Every employee earning up to ₹21,000 automatically gets the same rupee amount.

S.O. 4710(E) → calculation

इसके बाद actual entitlement समझने के लिए Section 26 of the Code on Wages, 2019 देखना चाहिए, क्योंकि 30-day work requirement, minimum bonus और maximum bonus framework Code में ही आता है.

अगर सवाल specifically Central Government employees के PLB/Non-PLB का है, तो applicable departmental sanction/order अलग से verify करना होगा।

Bottom line

इस notification की सबसे बड़ी headline ₹21,000 या ₹7,000 अकेले नहीं है।

सही formula यह है:

₹21,000 → Who falls within the notified eligibility ceiling

और

₹7,000 or Central minimum wage, whichever is higher → What wage base is used for an eligible employee earning above ₹7,000

इसलिए 25 August 2026 Gazette को “₹21,000 bonus announced” कहना गलत होगा।

ज्यादा accurate reading यह है कि Government ने Code on Wages के statutory bonus framework के दो key wage thresholds formally notify किए हैं, effective from 21 November 2025.
